2. General Information on Data Processing
2.1 Scope of Personal Data Processing
We process personal data in accordance with the provisions of the General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG), and other applicable data protection regulations, and only to the extent necessary to provide a fully functional website and our content and services.
2.2. Legal Bases for the Processing of Personal Data
To the extent that we obtain the data subject’s consent for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. When processing personal data necessary to fulfill a contract to which the user is a party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations necessary for the implementation of pre-contractual measures.
To the extent that the processing of personal data is necessary to comply with a legal obligation to which our company is subject, Article 6(1)(c) of the GDPR serves as the legal basis.
If processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights, and fundamental freedoms of the data subject do not override the aforementioned interest, Article 6(1)(f) of the GDPR serves as the legal basis for the processing. In this case, you have the right to object under Article 21 of the GDPR.
2.3. Data Erasure and Retention Period
Personal data is erased as soon as the purpose for which it was stored no longer applies. Data may also be retained if this is provided for by European or national legislators in EU regulations, laws, or other provisions to which the controller is subject.
3. Website Availability
3.1. Use of Hosting Service Providers
Our website is hosted on servers located in the EU that belong to a hosting service provider, based on a data processing agreement pursuant to Article 28 of the GDPR. As part of its services, the hosting service provider may have access to our users’ personal data, in particular to technical data generated during technical communication between you and our website (e.g., server log files). It is not permitted to use this data for its own purposes. The use of a hosting service provider serves our legitimate interest in ensuring that our online offering is secure, available, and performs well. The legal basis for this is Article 6(1)(f) of the GDPR.
3.2. Server Log Files
Every time you visit our website, your computer system automatically transmits data and information to our web server. This data is necessary for you to use our website with your computer system. This data includes: • The type and version of the browser you are using, • The type and version of the operating system you are using, • The URL of the page from which you accessed our site, • The date and time of your visit to our website, • The names of the subpages you accessed, • The IP address of your computer system, • The amount of data transferred in each instance. We temporarily store this data in so-called server log files. This data is not stored together with other personal data of users. This storage is carried out to ensure the security of our web servers and, if necessary, to assert, exercise, or defend legal claims (e.g., in the event of misuse of our services) on the basis of Article 6(1)(f) of the GDPR. The stored IP addresses are deleted after seven days at the latest, unless this data is still needed to assert, exercise, or defend legal claims.
3.3. Links to Websites of Other Operators
In some places on our website, links to other websites are provided. If you click on such a link, you will be redirected to the linked website. The privacy policy of the data controller whose website you have been redirected to will then apply.
4. Applications
You can send us applications via email. The data and files you submit will be processed and used exclusively for the purpose of reviewing your email application. The legal basis for this processing is Article 6(1)(b) of the GDPR in conjunction with Section 26(1) of the BDSG. Your personal application data will not be disclosed to third parties without your prior, express consent. If your application is successful, the data and files you provide may be further processed and used by us for employment-related purposes during the course of an employment relationship. Otherwise, your personal application data will generally be deleted automatically six months after the conclusion of the application process. This does not apply if legal provisions preclude deletion, if further storage is necessary for evidentiary purposes, or if you have expressly consented to longer-term storage. If we are unable to offer you a currently available position but believe, based on your profile, that your application might be of interest for future job openings, we will store your personal application data for twelve months, provided you expressly consent to such storage and use. You may withdraw your application at any time. To do so, please contact bewerbung@broetje.de in an informal manner. Your personal data stored up to that point will then be deleted immediately.

If we process your personal data, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller. Right of Access You have the right to request from us, at any time, information about the personal data we process concerning you, within the scope of Article 15 of the GDPR.
5.1 Right to Rectification
Pursuant to Article 16 of the GDPR, you have the right to request that we rectify and/or complete your personal data without delay if the personal data we process concerning you is inaccurate or incomplete.
5.2 Right to erasure
Pursuant to Article 17 of the GDPR, you have the right to request that we erase the personal data concerning you without undue delay. Right to Restriction of Processing: Pursuant to Article 18 of the GDPR, you have the right to request the restriction of the processing of your personal data.
5. 3 Right to be Informed
If you have exercised your right to rectification, erasure, or restriction of processing against us, we will notify all recipients to whom the personal data concerning you has been disclosed of this rectification, erasure, or restriction of processing, unless this proves impossible or involves disproportionate effort. Pursuant to Article 19 of the GDPR, you have the right to request that we inform you of these recipients.
5.4 Right to Data Portability
Pursuant to Article 20 of the GDPR, you have the right to receive from us the personal data concerning you that you have provided to us in a structured, commonly used, and machine-readable format and to transmit this data to other controllers. You also have the right to have the personal data concerning you transmitted directly from us to another controller, provided this is technically feasible.
5.5 Right to Object
Pursuant to Article 21 of the GDPR, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you that is carried out on the basis of Article 6(1)(f) of the GDPR. If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing purposes. If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.

5. 7 Right to Withdraw Consent
Pursuant to Article 7(3) of the GDPR, you have the right to withdraw any consent you have provided at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of that consent prior to withdrawal.
Right to lodge a complaint with a supervisory authority: Pursuant to Article 77 of the GDPR, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data violates the GDPR.
